| Kydmah is One service for all maintenance work, officially owned by Qamar Dhofar Trading and Contracting Company in the Sultanate of Oman, with Commercial Registration No. (1018593) and the service was established for mediation to provide maintenance and operation services. |
ﺧﺩﻣﺔ ﻣﺣﻁﺔ ﻭﺍﺣﺩﺓ ﻟﺟﻣﻳﻊ ﺃﻋﻣﺎﻝ ﺍﻟﺻﻳﺎﻧﺔ ﻣﻣﻠﻭﻛﺔ ﻟﺷﺭﻛﺔ ﻗﻣﺭ ﻅﻔﺎﺭ ﻟﻠﺗﺟﺎﺭﺓ ﻭﺍﻟﻣﻘﺎﻭﻻﺕ ﻭﺃﻧﺷﺋﺕ (1018593) : ﺍﻟﻣﺳﺟﻠﺔ ﺭﺳﻣﻳﺎً ﻓﻲ ﺳﻠﻁﻧﺔ ﻋﻣﺎﻥ ﺑﺳﺟﻝ ﺗﺟﺎﺭﻱ ﺭﻗﻡ ﺍﻟﺧﺩﻣﺔ ﻣﻥ ﺃﺟﻝ ﺍﻟﻭﺳﺎﻁﺔ ﻓﻲ ﺗﻘﺩﻳﻡ ﺧﺩﻣﺎﺕ ﺍﻟﺻﻳﺎﻧﺔ ﻭﺍﻟﺗﺷﻐﻳﻝ. |
| By ordering our services you unconditionally and unrestrictedly agree on this agreement, The platform is entitled at any time to amend this agreement and the amended version shall be published in our social platforms. The amended version (of the terms and conditions agreement) is effective as as of A week after publication date; thereafter, your continued use of the platform shall be deemed an obligation to you to abide by all the terms and conditions stated in the amended version and that you will apply the said amendments. |
ﻋﻧﺩ ﻁﻠﺑﻙ ﻹﺣﺩﻯ ﺧﺩﻣﺎﺗﻧﺎ ﻓﺈﻧﻙ ﺗﻭﺍﻓﻖ ﻋﻠﻰ ﻫﺫﻩ ﺍﻻﺗﻔﺎﻗﻳﺔ ﻣﻥ ﻏﻳﺭ ﻗﻳﺩ ﺃﻭ ﺷﺭﻁ، ﻭﻳﺣﻖ ﻟﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﻓﻲ ﺃﻱ ﻭﻗﺕ ﺗﻌﺩﻳﻝ ﻫﺫﻩ ﺍﻻﺗﻔﺎﻗﻳﺔ ﻭﺳﻳﺗﻡ ﻧﺷﺭ ﺍﻟﻧﺳﺧﺔ ﺍﻟﻣﻌﺩﻟﺔ ﻋﻠﻰ ﻗﻧﻭﺍﺕ ﺍﻟﺗﻭﺍﺻﻝ ﻟﺩﻳﻧﺎ، ﻭﺗﻛﻭﻥ ﺍﻟﻧﺳﺧﺔ ﺍﻟﻣﻌﺩﻟﺔ ﻣﻥ (ﺍﺗﻔﺎﻗﻳﺔ ﺍﻟﺷﺭﻭﻁ ﻭﺍﻷﺣﻛﺎﻡ) ﺳﺎﺭﻳﺔ ﺍﻟﻣﻔﻌﻭﻝ ﺑﻌﺩ ﺃﺳﺑﻭﻉ ﻣﻥ ﺗﺎﺭﻳﺦ ﻧﺷﺭﻫﺎ ﻓﻲ ﺍﻟﻣﻧﺻﺔ، ﻭﺑﻌﺩ ﺫﻟﻙ ﻳﻌﺗﺑﺭ ﺍﺳﺗﻣﺭﺍﺭﻙ ﻓﻲ ﺍﺳﺗﺧﺩﺍﻡ ﺍﻟﻣﻧﺻﺔ ﺍﻟﺗﺯﺍﻣﺎً ﻣﻧﻙ ﺑﺎﻟﺷﺭﻭﻁ ﻭﺍﻟﺑﻧﻭﺩ ﺍﻟﻭﺍﺭﺩﺓ ﻓﻲ ﺍﻟﻧﺳﺧﺔ ﺍﻟﻣﻌﺩﻟﺔ، ﻭﺭﺿﺎً ﻣﻧﻙ ﻓﻲ ﺗﻁﺑﻳﻖ ﺍﻟﺗﻌﺩﻳﻼﺕ. |
| Conditions of using services |
ﺃﺣﻛﺎﻡ ﺍﻻﺳﺗﻔﺎﺩﺓ ﻣﻥ ﺍﻟﺧﺩﻣﺎﺕ: |
| The role of Kydmah shall be limited to offering services of the Service Providers and mediating between the User and the Service Providers. The Platform shall not be responsible for quality level of the services provided by the Service Providers. Kydmah shall not bear any responsibility regarding the availability of the spare parts to be used. |
ﻳﻘﺗﺻﺭ ﺩﻭﺭ ﺧﺩﻣﺔ ﻋﻠﻰ ﻋﺭﺽ ﺧﺩﻣﺎﺕ ﻣﻘﺩﻣﻲ ﺍﻟﺧﺩﻣﺔ ﻭﺍﻟﺗﻭﺳﻁ ﺑﻳﻥ ﺍﻟﻌﻣﻳﻝ ﺍﻟﻣﺳﺗﻔﻳﺩ ﻭﻣﻘﺩﻣﻲ ﺍﻟﺧﺩﻣﺔ، ﻭﻻ ﺗﻌﺗﺑﺭ ﺧﺩﻣﺔ ﻣﺳﺅﻭﻟﺔ ﻋﻥ ﻣﺳﺗﻭﻯ ﻭﺟﻭﺩﺓ ﺍﻟﺧﺩﻣﺎﺕ ﺍﻟﻣﻘﺩﻣﺔ ﻣﻥ ﻣﻘﺩﻣﻲ ﺍﻟﺧﺩﻣﺔ، ﻭﻟﻳﺳﺕ ﺍﻟﻣﻧﺻﺔ ﻣﺳﺅﻭﻟﺔ ﻋﻥ ﺟﻭﺩﺓ ﻗﻁﻊ ﺍﻟﺻﻳﺎﻧﺔ ﺍﻟﺗﻲ ﻳﺗﻡ ﺍﺳﺗﺧﺩﺍﻣﻬﺎ. |
| The User may benefit from services of maintenance and operation from Kydmah after identifying the type of the service and the preferred available method to benefit from the platform services. |
ﻳﺳﺗﻔﻳﺩ ﺍﻟﻌﻣﻳﻝ ﻣﻥ ﺧﺩﻣﺎﺕ ﺍﻟﺻﻳﺎﻧﺔ ﻭﺍﻟﺗﺷﻐﻳﻝ ﺍﻟﻣﺗﺎﺣﺔ ﻋﻥ ﻁﺭﻳﻖ ﺧﺩﻣﺔ ﻭﺫﻟﻙ ﺑﻌﺩ ﺗﺣﺩﻳﺩﻩ ﻟﻧﻭﻉ ﺍﻟﺧﺩﻣﺔ ﻭﺍﺧﺗﻳﺎﺭﻩ ﻟﻠﻁﺭﻳﻘﺔ ﺍﻟﺗﻲ ﻳﻔﺿﻠﻬﺎ ﻣﻥ ﺍﻟﻁﺭﻕ ﺍﻟﻣﺗﺎﺣﺔ ﻟﻼﺳﺗﻔﺎﺩﺓ ﻣﻥ ﺧﺩﻣﺎﺕ ﺍﻟﻣﻧﺻﺔ. |
| The User and the Service Provider shall agree on the time of rendering the service through our social network platforms |
ﻳﺗﻡ ﺍﻻﺗﻔﺎﻕ ﺑﻳﻥ ﺍﻟﻌﻣﻳﻝ ﻭﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺣﻭﻝ ﺗﺣﺩﻳﺩ ﻭﻗﺕ ﺗﻧﻔﻳﺫ ﺍﻟﺧﺩﻣﺔ ﻣﻥ ﺧﻼﻝ ﻗﻧﻭﺍﺕ ﺍﻟﺗﻭﺍﺻﻝ ﻟﺩﻳﻧﺎ |
| The price of the service – workmanship- shall be set in advance through our customer service. The customer pays the cost of the service via the methods of payment available |
ﺑﺷﻛﻝ ﻣﺳﺑﻖ ﻋﻥ ﻁﺭﻳﻖ ﺧﺩﻣﺔ ﺍﻟﻌﻣﻼء ﻭﻳﻘﻭﻡ – ﺷﻐﻝ ﺍﻟﻳﺩ – ﻳﺗﻡ ﺗﺣﺩﻳﺩ ﺗﻛﻠﻔﺔ ﺍﻟﺧﺩﻣﺔ ﺍﻟﻣﺳﺗﺧﺩﻡ ﺑﺳﺩﺍﺩ ﻗﻳﻣﺔ ﺍﻟﺧﺩﻣﺔ ﻋﻥ ﻁﺭﻳﻖ ﻭﺳﺎﺋﻝ ﺍﻟﺩﻓﻊ ﺍﻟﻣﺗﺎﺣﺔ |
| Guarantee and Responsibility |
ﺍﻟﺿﻣﺎﻥ ﻭﺍﻟﻣﺳﺅﻭﻟﻳﺔ |
| Our work is limited to mediation, conciliation, and convergence of points of view (brokerage) between the client and the service provider. |
ﻳﻘﺗﺻﺭ ﻋﻣﻠﻧﺎ ﻋﻠﻰ ﺍﻟﻘﻳﺎﻡ ﺑﺧﺩﻣﺔ ﺍﻟﻭﺳﺎﻁﺔ ﻭﺍﻟﺗﻭﻓﻳﻖ ﻭﺗﻘﺭﻳﺏ ﻭﺟﻬﺎﺕ ﺍﻟﻧﻅﺭ (ﺍﻟﺳﻣﺳﺭﺓ) ﺑﻳﻥ ﺍﻟﻌﻣﻳﻝ ﻭﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ. |
| If the customer incurred any damages because of negligence or default from the Service Provider's side in rendering the service, the Service Provider shall bear the full responsibility before the User for the damages and for compensation. In case of any complaint regarding a poor quality service provided By any Service Provider, Kydmah shall send one of its maintenance man to detect and verify the problem. Kydmah shall not bear any responsibility or liability towards the User. Furthermore, the company retains the right to recourse to the Service Provider to claim any costs of maintenance service provided by Kydmah platform to resolve the customers problem resulting from the poor service quality of the Service Provider. Moreover, the Platform retains the right to recourse to the Service Provider to claim any compensation for any financial or moral damages to the Platform. |
ﺇﺫﺍ ﺗﻛﺑﺩ ﺍﻟﻌﻣﻳﻝ ﺃﻱ ﺃﺿﺭﺍﺭ ﺑﺳﺑﺏ ﺍﻹﻫﻣﺎﻝ ﺃﻭ ﺍﻟﺗﻘﺻﻳﺭ ﻣﻥ ﺟﺎﻧﺏ ﻣﺯﻭﺩ ﺍﻟﺧﺩﻣﺔ ﻓﻲ ﺗﻘﺩﻳﻡ ﻳﺗﺣﻣﻝ ﻣﺯﻭﺩ ﺍﻟﺧﺩﻣﺔ ﺍﻟﻣﺳﺅﻭﻟﻳﺔ ﺍﻟﻛﺎﻣﻠﺔ ﺃﻣﺎﻡ ﺍﻟﻣﺳﺗﺧﺩﻡ ﻋﻥ ﺍﻷﺿﺭﺍﺭ ، ﺍﻟﺧﺩﻣﺔ ﻭﺍﻟﺗﻌﻭﻳﺽ. ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻭﺩ ﺃﻱ ﺷﻛﻭﻯ ﺑﺧﺻﻭﺹ ﺳﻭء ﺟﻭﺩﺓ ﺍﻟﺧﺩﻣﺔ ﺍﻟﻣﻘﺩﻣﺔ ﻣﻥ ﺃﻱ ﻳﺟﺏ ﻋﻠﻰ ﺧﺩﻣﺔ ﺇﺭﺳﺎﻝ ﺃﺣﺩ ﻣﻭﻅﻔﻲ ﺍﻟﺻﻳﺎﻧﺔ ﻟﻛﺷﻑ ﺍﻟﻣﺷﻛﻠﺔ ﻭﺍﻟﺗﺣﻘﻖ ، ﻣﻘﺩﻡ ﺧﺩﻣﺔ ﺗﺣﺗﻔﻅ ، ﻣﻧﻬﺎ. ﻻ ﺗﺗﺣﻣﻝ ﺧﺩﻣﺔ ﺃﻱ ﻣﺳﺅﻭﻟﻳﺔ ﺃﻭ ﺍﻟﺗﺯﺍﻡ ﺗﺟﺎﻩ ﺍﻟﻣﺳﺗﺧﺩﻡ. ﻋﻼﻭﺓ ﻋﻠﻰ ﺫﻟﻙ ﺍﻟﺷﺭﻛﺔ ﺑﺎﻟﺣﻖ ﻓﻲ ﺍﻟﻠﺟﻭء ﺇﻟﻰ ﻣﺯﻭﺩ ﺍﻟﺧﺩﻣﺔ ﻟﻠﻣﻁﺎﻟﺑﺔ ﺑﺄﻱ ﺗﻛﺎﻟﻳﻑ ﻟﺧﺩﻣﺔ ﺍﻟﺻﻳﺎﻧﺔ ﺍﻟﺗﻲ ﺗﻘﺩﻣﻬﺎ ﺍﻟﺷﺭﻛﺔ ﻟﺣﻝ ﻣﺷﻛﻠﺔ ﺍﻟﻌﻣﻼء ﺍﻟﻧﺎﺗﺟﺔ ﻋﻥ ﺭﺩﺍءﺓ ﺟﻭﺩﺓ ﺍﻟﺧﺩﻣﺔ ﻟﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ. ﻋﻼﻭﺓ ﺗﺣﺗﻔﻅ ﺍﻟﻣﻧﺻﺔ ﺑﺎﻟﺣﻖ ﻓﻲ ﺍﻟﻠﺟﻭء ﺇﻟﻰ ﻣﺯﻭﺩ ﺍﻟﺧﺩﻣﺔ ﻟﻠﻣﻁﺎﻟﺑﺔ ﺑﺄﻱ ﺗﻌﻭﻳﺽ ﻋﻥ ، ﻋﻠﻰ ﺫﻟﻙ ﺃﻱ ﺃﺿﺭﺍﺭ ﻣﺎﻟﻳﺔ ﺃﻭ ﻣﻌﻧﻭﻳﺔ ﻟﻠﻣﻧﺻﺔ. |
| The Service Provider shall, solely, bear the responsibility if it violates any provisions hereof, any directives of Kydmah , directives of the Service Provider, or the guarantee conditions. |
ﻳﺗﺣﻣﻝ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﻭﺣﺩﻩ ﺍﻟﻣﺳﺅﻭﻟﻳﺔ ﺇﺫﺍ ﺧﺎﻟﻑ ﺃﻳًﺎ ﻣﻥ ﺃﺣﻛﺎﻡ ﻫﺫﻩ ﺍﻻﺗﻔﺎﻗﻳﺔ ﺃﻭ ﺃﻱ ﺗﻭﺟﻳﻬﺎﺕ ﻣﻥ ﺍﻟﺷﺭﻛﺔ ﺃﻭ ﺗﻭﺟﻳﻬﺎﺕ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺃﻭ ﺷﺭﻭﻁ ﺍﻟﺿﻣﺎﻥ. |
| In case of any damages to the customer because of the Service Provider’s violation, negligence or default, t he customer is entitled to submit a complaint against the Service Provider via one of our social media platforms. Moreover, the customer shall have the right to directly recourse to the Service Provider and to refer the claim to the competent authorities. |
، ﻓﻲ ﺣﺎﻟﺔ ﺣﺩﻭﺙ ﺃﻱ ﺃﺿﺭﺍﺭ ﻟﻠﻌﻣﻳﻝ ﺑﺳﺑﺏ ﺍﻧﺗﻬﺎﻙ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺃﻭ ﺇﻫﻣﺎﻟﻪ ﺃﻭ ﺗﻘﺻﻳﺭﻩ ﻳﺣﻖ ﻟﻠﻌﻣﻳﻝ ﺗﻘﺩﻳﻡ ﺷﻛﻭﻯ ﺿﺩ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﻋﺑﺭ ﺇﺣﺩﻯ ﻣﻧﺻﺎﺕ ﺍﻟﺗﻭﺍﺻﻝ ﺍﻻﺟﺗﻣﺎﻋﻲ ﻳﺣﻖ ﻟﻠﻌﻣﻳﻝ ﺍﻟﻠﺟﻭء ﻣﺑﺎﺷﺭﺓ ﺇﻟﻰ ﻣﺯﻭﺩ ﺍﻟﺧﺩﻣﺔ ﻭﺇﺣﺎﻟﺔ ، ﺍﻟﺧﺎﺻﺔ ﺑﻧﺎ. ﻋﻼﻭﺓ ﻋﻠﻰ ﺫﻟﻙ ﺍﻟﻣﻁﺎﻟﺑﺔ ﺇﻟﻰ ﺍﻟﺳﻠﻁﺎﺕ ﺍﻟﻣﺧﺗﺻﺔ. |
| The Service Provide shall provide a guarantee (for the workmanship) for one week from the date of rendering the service. |
ﻳﻘﺩﻡ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺿﻣﺎﻥ ﻋﻠﻰ (ﺷﻐﻝ ﺍﻟﻳﺩ) ﻟﻣﺩﺓ ﺃﺳﺑﻭﻉ ﻣﻥ ﺗﻧﻔﻳﺫ ﺍﻟﺧﺩﻣﺔ. |
| The Service Provider shall use original spare parts and shall provide a guarantee through the official agent thereof in the Sultane of Oman It shall deliver the guarantee card to the User to be able to benefit from the guarantee services. |
ﻳﻠﺗﺯﻡ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺑﺎﺳﺗﺧﺩﺍﻡ ﻗﻁﻊ ﺃﺻﻠﻳﺔ ﻭﺗﻭﻓﻳﺭ ﺿﻣﺎﻥ ﻣﻥ ﻭﻛﻳﻠﻬﺎ ﺍﻟﺭﺳﻣﻲ ﻓﻲ ﺳﻠﻁﻧﺔ ﻋﻣﺎﻥ ﻭﻳﻠﺗﺯﻡ ﺑﺗﺳﻠﻳﻡ ﻛﺭﺕ ﺍﻟﺿﻣﺎﻥ ﻟﻠﻣﺳﺗﺧﺩﻡ ﻟﻳﺗﻣﻛﻥ ﺍﻟﻣﺳﺗﺧﺩﻡ ﻣﻥ ﺍﻻﺳﺗﻔﺎﺩﺓ ﻣﻥ ﺧﺩﻣﺎﺕ ﺍﻟﺿﻣﺎﻥ. |
| The Customer is solely responsible for any malfunctions of the spare parts provided directly thereby. Kydmah and the Service Provider are not responsible for guaranteeing the said spare parts. |
ﺍﻟﻘﻁﻊ ﺍﻟﺗﻲ ﻳﺗﻡ ﺗﻭﻓﻳﺭﻫﺎ ﻣﻥ ﻗﺑﻝ ﺍﻟﻣﺳﺗﺧﺩﻡ ﺑﺷﻛﻝ ﻣﺑﺎﺷﺭ ﻳﺗﺣﻣﻝ ﺍﻟﻣﺳﺗﺧﺩﻡ ﻟﻭﺣﺩﻩ ﺍﻟﻣﺳﺅﻭﻟﻳﺔ ﻋﻥ ﺃﻱ ﺃﻋﻁﺎﻝ ﻧﺎﺗﺟﺔ ﻋﻧﻬﺎ، ﻭﻻ ﻳﻘﻊ ﻋﻠﻰ ﺍﻟﺷﺭﻛﺔ ﺃﻭ ﻣﻘﺩﻡ ﺍﻟﺧﺩﻣﺔ ﺃﻱ ﺍﻟﺗﺯﺍﻡ ﺑﺿﻣﺎﻧﻬﺎ. |
